These Terms and Conditions constitute a legally binding agreement between you (“the Client”) and Biggame Trail Adventures (“the Company,” “we,” “us,” “our”) governing your safari booking. By making a booking or using our services, you accept these terms in full.

1. THE BIGGAME TRAIL PROMISE & OUR DIFFERENCE

We specialize in wildlife-focused safaris with exclusive conservancy access. Unlike standard operators, we prioritize:

  • Precision Wildlife Tracking: Using guide networks and real-time communication to maximize sightings

  • Private Conservancy Partnerships: Direct relationships with Masai Mara, Samburu, and Laikipia conservancies

  • Conservation-Led Travel: A portion of every safari funds specific wildlife protection projects

  • Expert Field Guides: Guides with minimum 10+ years experience in their specific regions

2. BOOKING CONFIRMATION & PAYMENT TERMS

2.1 Deposit & Confirmation
Your safari is confirmed only upon receipt of a 30% non-refundable deposit of the total safari cost. This deposit secures your guides, conservancy permits, and accommodation allocations which we book immediately.

2.2 Final Payment
The remaining 70% balance must be paid 60 days prior to your safari start date. For bookings made within 60 days of travel, full payment is required immediately.

2.3 Our Pricing Transparency

  • All prices in US Dollars (USD)

  • Includes: Private 4×4 vehicles, expert driver-guide, all park/conservancy fees, accommodation, meals on safari, domestic flights as per itinerary, airport transfers on scheduled days

  • Excludes: International flights, visas, travel insurance, premium beverages, gratuities, personal purchases

  • No hidden fees – what we quote is what you pay for the services listed

3. CANCELLATION POLICY: CLEAR & STRAIGHTFORWARD

3.1 Client Cancellations
All cancellations must be in writing. Refunds (less non-refundable deposit) follow this schedule:

  • 60+ days before departure: Loss of 30% deposit only

  • 30-59 days before departure: 50% of total safari cost forfeited

  • Less than 30 days before departure: 100% of total safari cost forfeited

  • No refunds for unused services or early departure

3.2 Our Cancellation Rights
We reserve the right to cancel any safari due to:

  • Force Majeure events (see Section 7)

  • Failure to reach minimum group size for scheduled departures

  • Safety concerns or government advisories
    In such cases, you’ll receive: Full refund OR Credit for future travel (your choice)

4. CLIENT RESPONSIBILITIES: BE PREPARED

4.1 Travel Documents
You must possess:

  • Passport valid 6+ months beyond travel dates

  • Kenyan visa (e-visa available online)

  • Yellow Fever vaccination certificate (if required)

  • Travel insurance proof (mandatory)

4.2 Mandatory Travel Insurance
Comprehensive insurance is non-negotiable. It must cover:

  • Medical emergencies and evacuation

  • Trip cancellation and interruption

  • Lost/delayed baggage

  • Personal liability
    We may request proof before departure.

4.3 Health & Fitness
Safari involves rough terrain, early starts, and remote locations. By booking, you confirm fitness for participation and must disclose any conditions affecting your safety or experience.

5. SAFARI CONDUCT: OUR WILDERNESS CODE

5.1 Guide Authority
Our guides’ decisions are final regarding:

  • Wildlife viewing safety

  • Itinerary adjustments for weather or animal movements

  • Conduct in conservation areas

5.2 Conservation Ethics
You agree to:

  • Stay in vehicles unless guides permit otherwise

  • Maintain quiet during wildlife observations

  • No flash photography of animals

  • Respect conservancy rules and local communities

5.3 Zero Tolerance
We may terminate your safari, without refund, for:

  • Harassment of wildlife or staff

  • Substance abuse affecting safety

  • Repeated disregard for guide instructions

6. ITINERARY CHANGES & FLEXIBILITY

6.1 Our Commitment
While we deliver the experiences promised, safari by nature is unpredictable. We guarantee:

  • Access to the conservancies/parks booked

  • The quality of guiding and accommodation

  • Our commitment to your wildlife experience

6.2 Possible Adjustments
We may modify itineraries due to:

  • Weather conditions affecting access

  • Animal movements requiring route changes

  • Lodge/maintenance issues requiring alternative accommodation of equal standard
    Such changes don’t constitute grounds for refund.

7. FORCE MAJEURE: BEYOND OUR CONTROL

We’re not liable for circumstances including:

  • Natural disasters, severe weather, fires

  • Political unrest, terrorism, war

  • Pandemics, health emergencies, government travel restrictions

  • Transportation strikes or failures
    In such events, we’ll work with you on alternative arrangements or future credits.

8. LIABILITY: OUR COMMITMENT TO YOU

8.1 Our Responsibility
We’re responsible for providing services as described with reasonable care and skill. Our maximum liability for any claim is limited to the total amount you paid for the safari.

8.2 Exclusions
We’re not liable for:

  • Personal injury unless caused by our negligence

  • Loss/damage to personal belongings

  • Disappointment from wildlife sightings (while we maximize chances, we cannot guarantee specific animal encounters)

  • Acts of third-party suppliers (lodges, airlines) though we vet all partners thoroughly

9. CONSENT & MARKETING

By traveling with us, you grant permission for:

  • Photographs/videos taken during your safari to be used in our marketing (unless you opt out in writing)

  • Contact details to be shared with necessary suppliers (lodges, airlines)

10. LEGAL GOVERNANCE

10.1 Jurisdiction
These terms are governed by Kenyan law. Any disputes fall under the exclusive jurisdiction of Kenyan courts.

10.2 Dispute Resolution
We prefer direct resolution. Please contact us first at [Your Email]. If unresolved, we’ll seek mediation through the Kenya Association of Tour Operators (KATO) before legal action.

11. UPDATES TO THESE TERMS

We may update these terms periodically. The current version will always be on our website. Your booking is governed by the terms in effect at booking time.

12. YOUR ACCEPTANCE

By paying your deposit, you confirm:

  • You’ve read and understood these terms

  • You accept all conditions

  • You’re authorized to make this booking for all persons included
